
PSA Authorities Release Two Detainees in Jk.image/Kashmir life
In a significant legal development, the High Court of Jammu & Kashmir and Ladakh has taken decisive action, ordering the immediate release of two individuals who were previously detained under the Public Safety Act (PSA). Justice Sindhu Sharma’s Compassionate Decision
Justice Sindhu Sharma, presiding over the case of Mohammad Hanief Guroo from Rabitar, Gundi Roshan Ganderbal, exhibited a profound commitment to justice. Guroo’s detention, which stemmed from a directive issued by the Srinagar District Magistrate on the 10th of May 2023, has now been revoked. This bold move came as a result of Guroo’s habeas corpus petition, granted by Justice Sharma’s bench.
The court, fully aware of the importance of upholding individual freedoms, instructed the authorities to release Guroo from preventive custody promptly. The only exception to this directive would be if Guroo was required for involvement in another legal case, ensuring that the rule of law remains a cornerstone of their decisions.
Justice Rajnesh Oswal’s Firm Stand Against Unjust Detention
Justice Rajnesh Oswal, in a separate case, annulled the detention order issued against Adil Afzal Lone on the 7th of March 2022 by the Srinagar District Magistrate. In this instance, the court’s decision was driven by the observation that the authorities had not only disregarded constitutional norms but had also failed to meet statutory requirements.The court made it explicitly clear that the detention order was unsustainable due to these serious lapses. As a result, the court directed the authorities to release Adil Afzal Lone from custody without any unnecessary delay, unless he was indispensable to any ongoing legal matters.
