NCP Leader Mohammed Faizal P P Disqualified from Lok Sabha Membership After Kerala High Court’s Conviction Rejection

In a significant legal development, NCP leader Mohammed Faizal P P has been disqualified as a member of the Lok Sabha after the Kerala High Court rejected his plea for the suspension of his conviction in a murder case. This marks the second time Faizal has faced disqualification as a Lok Sabha member.

    Disqualification Following High Court Ruling

The disqualification of Mohammed Faizal P P as a Lok Sabha member was prompted by the Kerala High Court’s decision to reject his plea for the suspension of his conviction in a murder case. As a result, a Lok Sabha Secretariat bulletin declared, “In view of the order dated 03.10.2023 of the Hon’ble High Court of Kerala, Shri Mohammed Faizal P.P., Member of Lok Sabha representing the Lakshadweep Parliamentary Constituency of the Union Territory of Lakshadweep, stands disqualified from the membership of Lok Sabha from the date of his conviction, i.e., 11th January 2023.”

    A Second Disqualification for Faizal

This isn’t the first time that Mohammed Faizal P P has faced disqualification as a Lok Sabha member. He previously underwent disqualification on January 25, shortly after a sessions court in Kavaratti convicted him and three others on charges of attempting to murder P Salih. They were sentenced to rigorous imprisonment for 10 years. However, Faizal’s disqualification was revoked on March 29 following the suspension of his conviction and sentencing by the Kerala High Court.

Supreme Court’s Intervention in August 2023

In August 2023, the Supreme Court intervened in the matter by setting aside the Kerala High Court’s order. This decision came in response to an appeal filed by the Union Territory of Lakshadweep, ultimately leading to Faizal’s renewed disqualification as a Lok Sabha member.
