Jammu Court Summons SSP Over SHO’s Repeated Failure to File Report in Anticipatory Bail Plea
Jammu, October 1: The Court of 1st Additional Sessions Judge Jammu, presided over by Amarjeet Singh Langeh, has directed the Senior Superintendent of Police (SSP), Jammu, to ensure that the SHO of Police Station Channi Himmat files a report in an anticipatory bail matter after the police failed to comply with repeated court directions since August 22, 2026.
The order was passed in an anticipatory bail application filed by Jalaj Choudhary, represented by Advocate Nitin Gupta, against the Union Territory of J&K through SHO/In-charge, Police Station Channi Himmat, Jammu.
The court noted that the application was received on August 22, 2026, on which date the SHO was directed to file a report and the matter was listed for September 8. However, no report was filed on that date, following which the matter was adjourned to September 16.
The court further noted that the predecessor court had also passed an order for framing a Robkar against the SHO of the respondent police station.
Expressing strong concern over the continued non-compliance, the court observed that despite “plain and clear direction” issued to the SHO “not once, not twice but thrice,” the police officer had failed to file the required report.
“If orders passed by the courts fall on deaf ears, how judicial process would then move ahead,” the court observed.
The court emphasized that the law mandates expeditious disposal of bail applications, as the liberty of an individual is involved. It noted that the SHO had not filed the police report from August 22, 2026, till the date of the order, despite earlier orders expressing the court’s concern.
Taking note of the situation, the court directed SSP Jammu to cause the SHO to file the report by the next date without failure whatsoever.
The SSP has also been directed to seek an explanation from the SHO regarding the non-compliance and place the explanation before the court along with the police report.
The matter has been listed for October 7, 2026, while the interim order dated August 22, 2026, has been directed to continue.
