Delhi HC Issues Ruling on Copyright Dispute Between Storytelling Platforms
In a recent legal ruling, the Delhi High Court addressed a copyright dispute involving the popular storytelling platforms “Humans of Bombay” and “People of India.” The court’s decision clarified several key aspects related to the use of copyrighted material and private photos on these platforms.
Copyright Restrictions on Original Material
The court affirmed that “Humans of Bombay” and “People of India” cannot use each other’s copyrighted material, including original commissioned pictures, authored articles, and the specific manner and expression in which images are presented. This ruling underscores the importance of protecting the creative works and expressions unique to each platform.
No Copyright Claim for Private Photos
Importantly, the court specified that private photos shared by individuals on these platforms are not subject to copyright claims. This means that if a person voluntarily shares the same picture with both platforms, it does not constitute a copyright violation. The court recognizes that private photos from an individual’s personal collection are not subject to copyright protection.
Creative Expression and Copyright Infringement
The court emphasized that while there is no copyright in ideas, the expression of those ideas can be protected by copyright. It urged both platforms to adopt their unique creative expressions to convey and disseminate stories. The court’s order makes it clear that copying identical images and literary content, as well as the manner in which stories are presented, should be unique to each platform.
Additionally, the court noted that when photos are commissioned or videos produced by either platform (POI or HOB), the copyright for these works would belong to the respective platform, considering them as cinematographic works.
This ruling offers clarity on the use of copyrighted material and private photos on storytelling platforms and reinforces the importance of preserving the creative expressions and works of such platforms while respecting individual privacy and copyright protections.
