In the legal battle of LPA No. 70/2021 titled “Shahnawaz Ahmed Sheikh V/s UT of J&K Through Secretary, Govt. Of J&K, Social Welfare Department & ors,” a Division Bench comprising HON’BLE MR. The crux of the matter revolved around the alleged violation of interim court orders by the Jammu and Kashmir Service Selection Board, leading to a selection dispute with significant consequences.

In a bid to balance the scales of justice, the court adopted a pragmatic approach to resolve the complex situation.In 2009, the Social Welfare Department of Jammu and Kashmir advertised a position for Case Reader, which sparked a legal tussle.
Respondent No. 4, initially waitlisted for the role, challenged the selection of another candidate, Jyoti Sharma. The court issued interim orders to put the selection process on hold, but the Service Selection Board proceeded with the selection and appointed the appellant.Upon review, the court considered the unique circumstances and handed down a dual resolution.
First, it instructed the Service Selection Board to reconsider the claim of Meenakshi Jasrotia for the Case Reader position against the first advertised post, provided she proved more meritorious than Jyoti Sharma.
Second, it preserved the appointment of the appellant to a second Case Worker position, effectively nullifying the earlier quashing of the 2011 advertisement notification.In the event of Meenakshi Jasrotia’s selection and appointment, she would take precedence in seniority over the appellant. This resolution sought to strike a balance between upholding the integrity of the court’s interim orders and ensuring justice for all parties involved.
