Bihar Cabinet Approves Reservation in Promotions for Government Employees; supreme Court Stay Overturned

In a momentous decision, the Bihar cabinet has given its approval for implementing reservation in promotions for government employees, effectively reversing a stay imposed by the Supreme Court.

Formula for Reservations in 83% of Posts

S Siddharth, the principal secretary of the Cabinet Secretariat, revealed that the state government has devised a formula to introduce reservations in 83% of posts across all cadres. Beneficiaries from the Scheduled Castes and Scheduled Tribes will be assessed, and if their representation falls below 17% and 1%, the state will make appropriate decisions.

Effective from 2016

Reservation in promotions will be retroactively applied from the year 2016. In the event of an adverse ruling by the Supreme Court regarding reservations, employees from the reserved category who were promoted may face demotion. However, the state government has decided not to recover the pay difference and extra allowances paid to them during the intervening period.

Impact on Nearly 5 Lakh Government Servants

This decision is set to benefit nearly five lakh government employees in Bihar. The state government recently disclosed the results of the caste census conducted in the state, the first of its kind since Independence. The census revealed that approximately 84% of the state’s population consists of individuals from backward castes, including extremely backward, other backward castes, Scheduled Castes, and Scheduled Tribes.

Additional Cabinet Decisions

In addition to the promotion reservations, the cabinet also announced that employees who hold higher posts but are not awarded the corresponding pay scale will receive the pay scale matching their positions. Furthermore, uniform admission and other fees for graduate and postgraduate levels at all government dental hospitals in the state have been approved. There are also plans to expand the Regional Eye Institute at the Indira Gandhi Institute of Medical Sciences (IGIMS).

This decision marks a significant shift in government policy, ensuring that marginalized communities have equal opportunities for promotion within the public sector.
