In a recent development, the Delhi High Court has allowed both the Center and opposition political parties additional time to submit their responses regarding a Public Interest Litigation (PIL) seeking the prohibition of the acronym INDIA (Indian National Developmental Inclusive Alliance) by opposition political alliances. The bench, presided over by Justice Satish Chander Sharma and Justice Tushar Rao Gedela, has granted a two-week extension for respondents to file their replies, scheduling the next hearing for November 22, 2023.

Opposition Parties Contest the Petition

Senior Advocate Abhishek Manu Singhvi, representing the majority of opposition political parties involved, opposed the petition’s maintainability on legal grounds. The legal challenge pertains to the use of the INDIA acronym for opposition political alliances and has raised questions about its legality and appropriateness.

Election Commission’s Stand

The Election Commission of India (ECI) has clarified its role in the matter, stating that it cannot regulate political alliances. According to the ECI, its authority is established under Article 324 of the Constitution for supervising, directing, and controlling all elections in India. While the ECI has the power to regulate election-related matters, it does not have the authority to oversee political alliances, which are not recognized as regulated entities under the Representation of People Act, 1951 (RP Act) or the Constitution.

Implications for Political Landscape and Elections

The petitioner, Girish Upadhya, has expressed concerns that political parties using the INDIA acronym, combined with the national flag as their alliance’s logo, may manipulate and polarize innocent citizens. This strategic use is perceived as an attempt to garner sympathy and votes while potentially inciting political hatred and violence. The petitioner’s view is that the acronym could be confusing, as its defeat in the general election of 2024 might be portrayed as India’s overall defeat, affecting citizens’ sentiments and potentially leading to unrest.

The PIL argues that these actions by political parties could jeopardize the integrity of the upcoming general election in 2024, endangering citizens’ safety and the country’s law and order.
