IHC Judges Seek Guidance from Supreme Judicial Council
Judges of the Islamabad High Court (IHC) have expressed alarm over the alleged interference of Pakistan’s Inter-Services Intelligence (ISI) in judicial affairs. In a letter to the Supreme Judicial Council (SJC), six IHC judges highlighted instances of senior ISI officials influencing judicial proceedings and pressuring judges. They sought guidance on how judges should respond to such interference and intimidation, emphasizing the need for clarity in the code of conduct for judges.
The judges referenced the recent Supreme Court judgment declaring the removal of former IHC Justice Shaukat Aziz Siddiqui illegal. Justice Siddiqui had publicly alleged ISI interference in judicial affairs, leading to his removal. The verdict questioned the basis of the SJC’s actions against Justice Siddiqui and highlighted the need to investigate executive interference in judicial matters.
Call for Judicial Convention and Institutional Consultation
The IHC judges proposed convening a judicial convention to address the issue of intelligence operatives’ interference in judicial functions and intimidation of judges. They emphasized the importance of protecting judicial independence and holding accountable those who undermine it. Additionally, the judges called for institutional consultation to determine the extent of executive branch interference in judicial affairs and to develop mechanisms for safeguarding judicial independence. They urged the Supreme Court to consider measures to protect judges facing interference or intimidation.
The letter from the IHC judges underscores the importance of addressing allegations of ISI interference in judicial matters and ensuring the independence of the judiciary in Pakistan. It calls for collective action to protect judicial integrity and uphold the rule of law.
