Regret Over Inadvertent Inclusion of Misleading Statements
Balkrishna’s affidavit acknowledges that the offending sentences in the advertisement were included inadvertently, without the awareness of the court’s order, by the media department of Patanjali Ayurved. He emphasizes that the intention behind the advertisement was solely to promote the consumption of Ayurvedic products for leading a healthier lifestyle, backed by age-old literature and scientific research.
Calls for Modernization of Regulatory Framework
Highlighting the outdated state of Schedule J of the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, Balkrishna advocates for its modernization in light of advancements in Ayurvedic research. He underscores the need to incorporate evidence-based scientific data into regulatory frameworks to ensure the promotion of holistic and evidence-based solutions for lifestyle-related medical complications.
Response to Contempt Proceedings
Balkrishna’s affidavit responds to the Supreme Court’s earlier order, which sought a response from Patanjali Ayurved in contempt proceedings over alleged misleading advertisements. The court had expressed concerns about the company’s violation of its previous order cautioning against misleading advertisements about its medicines, and had restrained Patanjali Ayurved from making such statements in the media.
