Human Safety Prevails Over Stray Dogs, Urges Guidelines: Kerala High Court

In a recent ruling, the Kerala High Court emphasized the importance of prioritizing human safety over stray dogs and directed the State government to establish guidelines, schemes, or rules for licensing individuals interested in caring for stray dogs. The court acknowledged the rising menace of stray dogs, impacting students’ safety as they fear being attacked while going to school alone.

Concerns of Safety and Increasing Nuisance

Addressing the escalating issue, Justice PV Kunhikrishnan noted that the nuisance posed by stray dogs is on the rise, causing fear among students and residents. The court urged dog lovers to actively assist local government institutions in addressing the problem instead of merely expressing concerns through media channels.

Call for Cooperation and Licensing Measures

Justice PV Kunjikrishnan suggested that genuine dog lovers collaborate with local authorities to protect stray dogs. The court instructed the government to engage with the central government, if necessary, to formulate guidelines or schemes. Acknowledging the role of dog lovers, the court emphasized the need for proactive measures to curb the increasing menace of stray dogs.

Specific Case and Licensing Requirements

The court’s directives came in response to a petition filed by residents of Muzhathadam in Kannur, seeking action against an individual keeping stray dogs on his property. The court mandated the individual to apply for a license within a month, and the Kannur Corporation was instructed to issue the license under stringent conditions. Additionally, the court suggested that if the license application is not submitted, steps should be taken to remove stray dogs from the premises.

Intervention by Child Rights Commission

Last year, the Kerala State Commission for Protection of Child Rights intervened in the case, highlighting the increasing number of stray dog attacks, especially against children. The commission reported a significant rise in reported cases, emphasizing the urgent need for measures to address the safety concerns of children and residents.
