JK Administrative Council Greenlights 5 Special Courts for NDPS Act Trials
JAMMU, FEBRUARY 21: In a significant move, the Administrative Council (AC) convened under the leadership of Lieutenant Governor Manoj Sinha has given the nod to the establishment of five Special Courts, equipped with necessary personnel and infrastructure, for the trial of offences under the NDPS Act. The allocation includes one court for each of the districts: Anantnag, Baramulla, Jammu, Pulwama, and Srinagar within the Union Territory of Jammu and Kashmir.
Legal Mandate and Authorities’ Presence:
Rajeev Rai Bhatnagar, Advisor to the Lieutenant Governor; Atal Dulloo, Chief Secretary; and Mandeep Kumar Bhandari, Principal Secretary to Lieutenant Governor were among the key attendees at the meeting. This strategic decision aligns with the directives of the High Court, specifically referencing cases such as ‘Thana Singh vs Central Bureau of Narcotics’ and ‘Arshad Ahmad Allaie Vs UT of J&K’.
Judicial Recommendation and Approval:
The creation of these Special Courts follows a resolution from the Committee of Judges of the J&K High Court. Their recommendation emphasized the necessity to establish these courts, particularly in districts where the backlog of NDPS cases surpasses the 500 mark. The Chief Justice has duly approved this recommendation, further solidifying the commitment to expedite legal proceedings in these areas.
Financial Implications and Commitment to Justice:
Notably, this proactive step will incur an annual financial commitment of Rs.4.65 Crore for the Union Territory. The decision underscores the dedication of the Administrative Council and the Judiciary to address the mounting caseload efficiently and ensure the swift delivery of justice.
This move is a testament to the commitment of the Jammu and Kashmir administration to enhance the judicial infrastructure, expedite legal proceedings, and effectively address the rising number of NDPS cases within the region.
