Gujarat High Court Dismisses AAP Leaders’ Pleas to Quash Summons in Defamation Case
The Gujarat High Court has dismissed the pleas filed by Aam Aadmi Party (AAP) leaders Arvind Kejriwal and Sanjay Singh seeking to quash the summons issued against them in a criminal defamation case related to their comments on Prime Minister Narendra Modi’s educational qualification. The summons were issued by a trial court in a case filed by Gujarat University (GU), and the High Court directed Kejriwal and Singh to present their submissions before the trial court. The AAP leaders had challenged the summons, arguing that GU should have filed a defamation case before a sessions court instead of a magistrate court.
The defamation case was filed by GU over comments made by Kejriwal and Singh, which the university deemed “sarcastic” and “derogatory” regarding PM Modi’s degree. The metropolitan court had summoned the AAP leaders in April 2021, and the subsequent revision applications challenging the summons were dismissed by the sessions court. The High Court rejected their plea for an interim stay, and the Supreme Court also declined to entertain their pleas. GU’s registrar had filed the defamation case after the High Court set aside the Central Information Commission’s order concerning PM Modi’s educational qualification. The court directed the sessions court to conclude the hearing within ten days.
This legal development adds to the ongoing legal challenges faced by political figures involving defamation cases and highlights the complexities surrounding public statements and political discourse.
