Hemant Soren Moves Supreme Court, Alleges Abuse of Power by ED
Jharkhand Mukti Morcha (JMM) chief Hemant Soren has approached the Supreme Court against the Enforcement Directorate’s (ED) actions, alleging an abuse of power and a malafide attempt to destabilize a democratically elected government in Jharkhand. The petition filed through advocate Pragya Baghel seeks an urgent hearing, with the Supreme Court agreeing to list it on Friday, February 2. Soren contends that his custody is illegal, malafide, and without jurisdiction. He urges the court to declare the arrest unwarranted, arbitrary, and violative of his fundamental rights under Article 21 of the Constitution.
Allegations of Brazen Action by Enforcement Directorate
In the petition, Hemant Soren accuses the ED of acting under the dictates of the Central Government, hounding him to destabilize the democratically elected government. He highlights that despite intimating the ED about the petition and requesting them to await the Supreme Court’s proceedings, the agency took him into custody from the Governor house, where he had gone to tender his resignation as Chief Minister. Soren claims that the ED’s actions are a deliberate attempt to make the writ petition infructuous.
Challenge to ED Summons and Alleged Harassment
Soren challenges the ED’s summons, asserting that they are illegal, null, and void, violating the Prevention of Money Laundering Act’s provisions and his fundamental rights. He claims constant harassment by the ED and accuses the agency of misusing its authority at the behest of political rivals. The petition seeks the quashing of impugned summons and all proceedings emanating from them.

Hemant Soren’s arrest by the ED is related to a land scam case involving substantial amounts of proceeds of crime generated through forged official records.
