SC to Scrutinize BCI Rules on Lawyer Strikes
The Supreme Court has decided to examine the rules proposed by the Bar Council of India (BCI) to address issues related to strikes by lawyers. BCI Chairman Manan Kumar Mishra submitted a draft rule, emphasizing the council’s willingness to accept any suggestions from the court without conditions. The court, headed by Justices Sudhanshu Dhulia and SVN Bhatti, agreed to scrutinize the rules and listed the matter for further hearing in February. The BCI has considered suggestions, including those from petitioner Prashant Bhushan, while drafting rules to regulate lawyer strikes. The court was dealing with a contempt petition filed by the NGO Common Cause, seeking action against lawyers abstaining from work.
BCI Urges Practical Approach Amid Controversy
During the hearing, Prashant Bhushan proposed measures such as refusing to call meetings for strike consideration and initiating immediate disciplinary action against those calling strikes. BCI Chairman Mishra urged practicality, emphasizing that lawyers should not be denied the right to observe a strike in protest. Justice Dhulia recalled his initial experiences in the Allahabad High Court and noted improvements. Bhushan acknowledged the court’s role in mitigating the issue but stressed the need for clear rules. The BCI submitted draft rules for the court’s consideration, seeking prompt approval for their implementation.
