SC-Extends Deadline for Verdict on Maharashtra Disqualification Cases
The Supreme Court has granted an extension until January 10, 2023, to Maharashtra Legislative Assembly Speaker Rahul Narwekar for delivering a verdict on disqualification petitions, including the one involving Chief Minister Eknath Shinde.
The Speaker, seeking additional time to resolve the petitions against rebel MLAs from Shiv Sena and NCP, was earlier instructed by the court to decide by December 31, 2023.During the hearing, the bench headed by Chief Justice of India DY Chandrachud and Justices JB Pardiwala and Manoj Misra deliberated after the Speaker’s Solicitor General Tushar Mehta disclosed that proceedings would conclude by December 20, 2023. Mehta highlighted the extensive examination of over 2,71,000 pages of documents, necessitating the requested three-week extension.
Senior advocate Kapil Sibal, representing the Uddhav Thackeray group, contested the extension, citing the Speaker’s previous plea for more time. Despite objections, considering the previously established timelines, the bench granted an extension till January 10, 2023, to the Speaker for delivering the verdict.
The top court’s earlier directive required the Speaker to decide on disqualification petitions related to internal rifts in Shiv Sena and NCP by December 31, 2023, and January 31, 2024, respectively. However, the court rejected the Speaker’s proposal to conclude proceedings by February 29, 2024, emphasizing the need for a timely resolution given the Constitutional obligations and the duration of the case.
The petitions, involving 34 cases filed by rival Shiv Sena groups, seeking disqualification of 56 MLAs, have been pending since the commencement of the Maharashtra political crisis.
The delay prompted criticism from the court, which noted the constitutional implications and urged a time-bound resolution of the pending disqualification pleas.
