Bombay HC Denies Bail to Chintan Upadhyay in Double Murder Case
The Bombay High Court declined to suspend the life sentence and grant bail to artist Chintan Upadhyay, who was convicted for abetting and conspiring to kill his estranged wife Hema Upadhyay and her lawyer Haresh Bhambani in December 2015.
Upadhyay moved the high court in October, challenging a sessions court order that found him guilty and sentenced him to life imprisonment.
He contended that the trial court’s judgment lacked substantial evidence and reasoning to convict him.
Seeking suspension of his sentence and release on bail until his appeal hearing, Upadhyay’s plea was dismissed by a division bench of Justices Revati Mohite Dere and Gauri Godse on Monday.
The High Court will hear his appeal against the conviction order in the due course of proceedings.
The tragic incident occurred on December 11, 2015, when Hema and her lawyer Haresh Bhambhani were murdered, their bodies stuffed into cardboard boxes and dumped into a ditch in Mumbai’s Kandivali area.
Additional sessions judge S Y Bhosale from the Dindoshi court found Chintan Upadhyay guilty of abetment and conspiracy in the case.
Furthermore, three other accused, including the tempo driver Vijay Rajbhar and helpers Pradeep Rajbhar and Shivkumar Rajbhar, were also held accountable for the double murder.
They worked alongside the absconding accused, art fabricator Vidyadhar Rajbhar, who was also found guilty in this shocking crime.
