Rajya Sabha Passes Jammu and Kashmir Bills Amid Opposition Ruckus
In a swift move amid the opposition’s uproar over the recent Parliament security breach, the Rajya Sabha approved two bills related to Jammu and Kashmir within a mere 10 minutes. Union Minister of State for Home Nityanand Rai introduced the Jammu and Kashmir Reorganisation (Second Amendment) Bill, 2023, and the Government of Union Territories (Amendment) Bill, 2023 for consideration and passage.
As the opposition chose not to engage in discussions regarding these bills, occupying the well of the House and demanding Home Minister Amit Shah’s statement on the security breach incident in Lok Sabha, the Upper House proceeded to pass the bills through a voice vote without any deliberation.
The Jammu and Kashmir Reorganisation (Second Amendment) Bill, 2023 aims to amend the Jammu and Kashmir Reorganisation Act, 2019, which reserves approximately one-third of all elected seats in the Jammu and Kashmir Legislative Assembly for women. This reservation extends to seats allocated for Scheduled Castes and Scheduled Tribes and will be effective post the census conducted after the bill’s commencement. The provision of this reservation will last for 15 years or until determined otherwise by a Parliament-made law.
Similarly, the Government of Union Territories (Amendment) Bill, 2023 seeks to allocate 33% of seats in the Jammu and Kashmir and Puducherry Assemblies for women. The bill also reserves one-third of all elected seats in the Puducherry Legislative Assembly for women, including those for Scheduled Castes and Scheduled Tribes. Like the previous bill, this reservation will come into effect after the post-commencement census and endure for 15 years or until amended by a Parliament-made law.
The bills prescribe a rotation of seats for women in line with Parliament-made laws after each delimitation process. Despite the opposition’s protest, these legislative changes have now been ratified by the Rajya Sabha.
