The Michigan Supreme Court has declined a bid to exclude former President Donald Trump from the 2024 primary ballot based on the US Constitution’s “insurrectionist ban,” as reported by CNN. In contrast to the recent Colorado Supreme Court decision, which removed Trump from its primary ballot due to his role in the Capitol riot, this decision in Michigan was dismissed on procedural grounds without delving into the insurrection-related questions or Trump’s involvement.

Unlike Colorado’s election code, Michigan law lacks a provision mandating presidential candidates to affirm their eligibility to hold office, a factor highlighted by Justice Elizabeth Welch. The decision was made on procedural disparities between Michigan law and Colorado’s election code.

Although this dismissal keeps the door open for future 14th Amendment challenges if Trump secures the Republican nomination, the legal battle continues. Trump, via Truth Social, criticized attempts to exclude him, cautioning against a “rigged and stolen” 2024 election.

Despite the disappointment expressed by legal representatives like Ron Fein of Free Speech For People and Mark Brewer, who vowed to continue efforts in Michigan, the decision’s broader impact remains non-binding outside Michigan. The 14th Amendment challenge by Free Speech For People sought to apply the “insurrectionist ban” and forms part of a larger legal strategy pursued by the group.
