Legal Provisions and Consequences
The circular referenced Rule 20(ii) of the Jammu and Kashmir Government Employees (Conduct) Rules, 1971, which explicitly prohibits government employees from participating in any form of strike related to their service or the service of other government employees. It reiterated that this rule is not just declaratory but carries severe consequences for violators.
Furthermore, the circular cited Supreme Court rulings, including the case of T.K. Rangarajan vs Government of Tamil Nadu, where the court asserted that employees have no inherent right to strike. The court emphasized that strikes disrupt society and governance, and employees must seek redressal through established statutory channels rather than resorting to strikes. The circular warned that any employee found violating these rules would face strict legal action.
