The Directorate of Enforcement (ED) opposes granting interim bail to Delhi Chief Minister Arvind Kejriwal, asserting that politicians shouldn’t receive preferential treatment. In a fresh affidavit filed in the Supreme Court regarding the Delhi excise policy case, ED contends that politicians are subject to the same legal obligations as ordinary citizens, including arrest and detention for offenses.
ED’s stance comes amidst a bench of Justices Sanjiv Khanna and Dipankar Dutta considering interim bail for Kejriwal to facilitate campaigning for the upcoming Lok Sabha elections in Delhi. However, ED underscores that campaigning is not a legal, constitutional, or fundamental right and should not warrant special treatment for politicians.
The agency further argues that granting interim bail solely for political campaigning would undermine equality under the law and set a dangerous precedent. It emphasizes the importance of upholding the rule of law and equality, irrespective of one’s political stature.
Kejriwal’s legal battle against his arrest by the ED, related to alleged irregularities in the Delhi excise policy, unfolds in the apex court. His arrest and subsequent remand face scrutiny, with Kejriwal challenging the Delhi High Court’s dismissal of his plea for release. The High Court had cited his non-cooperation with ED summons as grounds for arrest, rejecting claims of political vendetta. Kejriwal’s arrest by the ED on March 21 is part of a money laundering probe linked to the excise policy case.
