In a significant development, the Supreme Court expressed concerns about the indefinite suspension of AAP lawmaker Raghav Chadha from the Rajya Sabha and its potential impact on people’s right to be represented by their chosen representatives. The court raised questions about the Privileges Committee of Parliament’s authority to order such suspensions without specifying a duration.

The bench, led by Chief Justice DY Chandrachud, underscored the gravity of the situation, emphasizing that excluding an opposition member from the House due to a difference in perspective, even one inconsistent with the government’s viewpoint, is a matter of great significance.

Raghav Chadha had been under suspension since August 11, following allegations by several MPs, predominantly from the ruling BJP, that he included their names in a motion for the formation of a select committee without their consent. This motion pertained to the examination of the contentious Delhi Services Bill.

The Supreme Court questioned whether Chadha’s actions, which involved not seeking permission from certain MPs before including their names in the proposed select committee, warranted an indefinite suspension, particularly given the potential ramifications on people’s right to choose their representatives.

The court emphasized that Parliament must accommodate diverse voices representing a spectrum of perspectives, and the indefinite suspension of a member, especially from the opposition, could hinder this vital democratic process. They stressed that as a constitutional court, this matter raised serious concerns and that excluding voices from the Parliament should be approached with great caution.

With 75 days having passed since Chadha’s suspension and the upcoming Winter session, the bench expressed concerns about his continued exclusion from the parliamentary proceedings. Chadha’s suspension was initiated during the last day of the Monsoon session, citing reasons such as gross violation of rules, misconduct, defiant attitude, and contemptuous conduct. The suspension was pending a report from the Privileges Committee.
