Supreme Court Acquits Woman Convicted of Killing Newborn Child Due to Lack of Evidence
India’s Supreme Court has acquitted a woman who was convicted by a trial court for the alleged killing of her newborn child, citing a lack of conclusive proof to establish her guilt. The top court emphasized the importance of a thorough evaluation of evidence in cases resulting in life imprisonment sentences and warned against mechanical and perfunctory decisions.

The Supreme Court highlighted the inviolable right to privacy, emphasizing that thrusting the guilt of killing a child upon a woman without substantial evidence merely because she lived alone in a village perpetuates cultural stereotypes and gendered identities. The court recognized the woman’s right to make decisions about her pregnancy and reiterated the significance of privacy in such matters.
Lack of Evidence
The court pointed out the absence of any solid foundation to support the woman’s guilt. It noted that no relationship between the woman and the deceased child was established, and none of the witnesses had seen her disposing of the child. The court also questioned the conclusiveness of the doctor’s testimony, as it lacked key details regarding the timing of the child’s death.
Acquittal Based on Presumption
Considering the gaps in the prosecution’s case and the lack of substantial evidence beyond a reasonable doubt, the Supreme Court ruled that the woman’s conviction was entirely based on presumption. It criticized the high court for confirming the trial court’s decision to award life imprisonment without providing sufficient reasons.
