    The Supreme Court of India has taken a significant step by referring a set of petitions challenging the electoral bond scheme for political party funding to a five-judge Constitution bench. This move underscores the importance of scrutinizing the validity of the scheme and its implications on political funding.

    Urgent Matter Sent to Larger Bench

    A bench led by Chief Justice D Y Chandrachud, alongside justices J B Pardiwala and Manoj Misra, considered an application, emphasizing the urgency of the matter and the need for a conclusive judgment. As a result, they decided to refer the issue to a larger bench, which will convene on October 30, maintaining the hearing date previously scheduled.

    Electoral Bond Scheme under Legal Scrutiny

    Notably, the bench had earlier acknowledged lawyer Prashant Bhushan’s submissions, highlighting the importance of adjudicating the matter before the electoral bond scheme becomes operational for the 2024 general elections. The decision to fast-track the case for a final hearing was a testament to the significance of the legal challenge.

    Multiple PILs Addressing the Issue

    The case involves four Public Interest Litigations (PILs) addressing the electoral bond scheme’s concerns. In March, one of the PIL petitioners had raised the issue of substantial sums, approximately Rs 12,000 crore, being channeled to political parties through electoral bonds. It was noted that a significant portion of these funds had been directed to a particular major political party.

    Electoral Bonds and Transparency in Political Funding

    Electoral bonds were introduced as an alternative to cash donations to political parties with the aim of increasing transparency in political funding. The upcoming legal proceedings will play a crucial role in examining the effectiveness of the electoral bond scheme and its implications for political financing in India.

    This development underlines the importance of transparency and accountability in the political funding process, a cornerstone of a healthy democracy.
