Supreme Court Expresses Concern Over Delay in Child Adoptions, Seeks Simplification of Process: Addressing Delays in Child Adoptions
The Supreme Court of India has expressed serious concerns about the significant delays in the child adoption process and questioned why no steps have been taken to simplify the process. The Court emphasized that child adoption is a “human thing” and observed that many children are waiting for adoption in the hope of a better life. A bench headed by Chief Justice Dhananjaya Y Chandrachud noted the “grave delay” in adoptions, with couples waiting for three to four years and asked why adoptions are being stalled and why the Central Adoption Resource Authority (CARA) is not addressing the issue.
Petitions Highlight Adoption Delays
The Supreme Court’s concerns were raised while hearing two petitions that pointed out deficiencies in the adoption process leading to significant delays. NGO Temple of Healing, one of the petitioners, informed the Court that despite over 30 million orphans in the country, only 4,000 adoptions occur annually. The Court stated, “It’s a human thing, as people want to adopt and are eager to have children.”
Government Response and Future Actions
Additional Solicitor General Aishwarya Bhati requested additional time to file a response to the petition. The Court listed the petitions for hearing on October 30 and allowed the Centre to file its response by then, indicating steps to simplify the procedure. The Court also pondered over the practical difficulties caused by adoption delays, as the positions of both parents and children may change during the process. The Court emphasized the need for collaborative efforts to address these issues and seek solutions to streamline the adoption process.
The Court’s decision reflects its commitment to addressing the delays in child adoptions and ensuring a more efficient and streamlined process.
