Islamabad HC Overrules Objection to PTI Petition Against CDA Raid

The Islamabad High Court (IHC) has overruled an administrative objection to a petition filed by the Pakistan Tehreek-e-Insaf (PTI) against the Capital Development Authority’s (CDA) raid on its party head office, according to Dawn. PTI Secretary General Omar Ayub, through Advocate Shoaib Shaheen, submitted the plea. Justice Saman Rafat Imtiaz dismissed the IHC registrar’s office’s objection that the petition lacked due authorization.
The court was initially scheduled to hear arguments on the petition on Tuesday. However, the hearing was postponed due to a public holiday declared by the federal government to observe Youm-i-Takbeer, the day Pakistan became a nuclear power in 1998. The IHC will remain closed, and the hearing will be rescheduled accordingly, Dawn reported.
Last week, the CDA demolished what it claimed were encroachments and sealed the PTI secretariat. PTI leaders Omar Ayub, Shoaib Shaheen, and Amer Baloch filed a petition requesting the court to declare the CDA’s demolition order illegal, as reported by ARY News.
In its petition, PTI described the operation and sealing of its secretariat as lacking lawful authority, being motivated by political victimization, and contrary to the provisions of the Constitution of the Islamic Republic of Pakistan, 1973. PTI Chairman Barrister Gohar Ali Khan condemned the demolition, accusing authorities of violating the sanctity of the party’s central secretariat in Islamabad.
The CDA defended its actions, stating that the plot was allotted to an individual named Sartaj Ali and that an additional floor was constructed in violation of building rules, according to Geo News. During the operation, PTI activists resisted the CDA’s attempts to demolish the office, leading to the arrest of some party workers by Islamabad authorities.
