
Court Rejects Bail for 10 Separatist Leaders Charged with Reviving Banned Outfit.
Nature of the Offense
A special court in Srinagar, under the purview of the NIA Act, took a stern stance on Monday by rejecting the bail applications of 10 second-rung separatist leaders. These individuals were apprehended on charges related to their alleged attempts to resurrect the outlawed Jammu and Kashmir Liberation Front (JKLF). This decision was made by Additional Sessions Judge Srinagar Sandeep Gandotra, who asserted that releasing the separatist leaders on bail at this stage would jeopardize public and state interests.
Public and State Interests at Stake
Judge Gandotra underlined the gravity of the offense and the broader concerns for state security. He cited Section 43(D) proviso 5, explaining that it applied to the current case and justified the denial of bail. The court’s concern extended to the potential risks to public interests and the well-being of the state or union territory should the accused be granted bail. Consequently, the court dismissed the bail applications, directing them to be recorded as per the established rules.

Notably, the court consolidated the hearings for the bail applications, streamlining the process to reach a conclusive decision efficiently.
Merits of the Main Case Unaffected
Judge Gandotra clarified that the rejection of the bail applications should not be misconstrued as an expression of opinion regarding the merits of the main case against the separatist leaders.
The 10 individuals seeking bail, namely Firdous Ahmad Shah, Jahangir Ahmad Bhat, Saheel @ Suhail Ahmad Mir, Khursheed Ahmad Bhat, Syed Rehman Shams, Sajad Hussain Gul, Mohammad Rafiq Phaloo, Gh. Hassan Parray @ Firdousi, Mohammed Yaseen Bhat, and Shabir Ahmad Dar, had been taken into custody in July of this year. They faced allegations of attempting to revive the JKLF, a group banned by the Centre in March 2019.
