Rajya Sabha Passes Bill Extending Protection for Unauthorized Developments in Delhi
The National Capital Territory of Delhi Laws (Special Provisions) Second (Amendment) Bill, 2023, received approval through a voice vote in the Rajya Sabha on Tuesday, after its earlier passage in the Lok Sabha. This legislation primarily aims to prolong the protection provided under a central act concerning unauthorized colonies and slum resettlement.
The amendment pertains to the National Capital Territory of Delhi Laws (Special Provisions) Second Act, 2011. This act shields unauthorized development and encroachments in Delhi from punitive measures, encompassing various entities like slum inhabitants, street vendors, unauthorized colonies, educational and cultural institutions, and agricultural storage units.
The bill necessitates the central government to undertake specific actions addressing these issues, such as establishing norms, formulating policy guidelines, devising relocation strategies, and ensuring systematic rehabilitation.
Extending the validity of the National Capital Territory of Delhi Laws (Special Provisions) Second Act from January 1, 2024, to December 31, 2026, remains the central objective. The extension aims to safeguard various unauthorized developments in Delhi, shielding a diverse range of entities including slum dwellers, street vendors, educational and cultural institutions, and agricultural storage facilities from punitive actions.
Proponents of the bill argue that the complexities involved in tackling unauthorized constructions warrant an extension to provide continued protection. They highlight the ongoing processes aimed at addressing unauthorized developments, such as finalizing development control norms and the Master Plan for Delhi-2041.
However, critics argue that continually pushing back deadlines serves as a temporary fix rather than offering a policy-driven solution. The Housing Affairs Minister countered these arguments by emphasizing that the extension was essential; otherwise, Delhi’s vulnerable population would face the prospects of “ceiling, demolition, and displacement.”
The National Capital Territory of Delhi Laws (Special Provisions) Second Act, 2011, has witnessed multiple extensions since its initial validity until December 31, 2014. The recent amendment in 2021 extended it until December 31, 2023, and the current approval from the Lok Sabha further extends its validity until December 31, 2026.
