    Jammu Kashmir Government Authorises More Officers to Exercise Powers Under NDPS Act

    Jammu, September 02, 2026 [VoM News]: The J&K government has now allowed more officers of different departments to exercise authorities under Section 41(2) of the NDPS Act within the Union Territory.

    According to the Jammu and Kashmir Government order, all gazetted officials both from J&K Police and J&K Excise department have now been granted permission to take actions as empowered under the relevant section.

    In addition, the powers will now also be accessible to several officials from the Revenue Department such as the Additional Deputy Commissioners, Assistant Commissioners Revenue, Sub-Divisional Magistrates, Tehsildars (Territorial) and Naib Tehsildars (Territorial).

    These officers will only be able to use these powers on cases happening within the Union Territory limits of Jammu and Kashmir and under the specific clause i.e. Subsection (2) of the 41 section of the NDPS Act.

    Section 41 of the law is a significant part when it comes to giving authorities for action, so the order in official terms validates this empowerment which comes as official government mandate.

    This order has been issued by the administration using powers provided to it in sub-section (2) of Section 41 of the NDPS Act, which is also known as the Act 61 of 1985.
