TMC Leader Mahua Moitra Moves Delhi High Court Against Notice to Vacate Government Accommodation
Mahua Moitra, a prominent leader of the Trinamool Congress (TMC), has filed a petition in the Delhi High Court seeking the annulment of a notice issued by the Directorate of Estate that calls for the cancellation of her Government Accommodation in Delhi.
The plea, filed recently, highlights a notice issued to Moitra on December 11, 2023, mandating her to vacate the residence by January 7, 2024. Failure to comply would lead to proceedings under the Public Premises (Eviction of Unauthorised Occupants Act) 1971 (‘PP Act 1971’).
This notice comes in the wake of Moitra’s recent expulsion from the Lok Sabha due to allegations related to the ‘cash-for-query’ issue. The plea contests that the cancellation of Moitra’s allocated accommodation is based on her expulsion from the Lok Sabha, which is presently under judicial review in the Supreme Court of India. The matter at hand raises pivotal questions pertaining to constitutional interpretation.
The petition implores the court to permit Moitra to retain possession of her government residence until the results of the 2024 General Elections are declared.
Additionally, the plea highlights that the absence of official accommodation poses a significant obstacle to Moitra’s ability to convene and engage with party members, parliamentarians, colleagues from the political spectrum, constituents, crucial stakeholders, and other dignitaries. These interactions hold paramount importance, particularly in the lead-up to a general election.
