Six sources revealed to Reuters that discussions on ‘foundation models,’ a category encompassing generative AI, have become a major hurdle in the negotiations. The European Parliament approved the bill in June after two years of deliberation, but now, crucial talks scheduled for Dec. 6 hang in the balance.

Foundation Models: A Stumbling Block in AI Legislation Talks

Foundation models, exemplified by Microsoft-backed OpenAI’s creation, are AI systems trained on extensive datasets, capable of learning from new data for diverse tasks. Negotiations now revolve around the EU’s stance on these models, access to source codes, and proposed fines. EU experts meet to establish their position, while Parliamentarians work to finalize their stance. Failure to reach an agreement could lead to the act being shelved, with time constraints before the next European parliamentary elections.

Experts and lawmakers differ on a tiered approach for regulating foundation models, with France, Germany, and Italy advocating for self-regulation. The biggest challenge arises from these countries, favoring a hands-off approach instead of imposing stringent rules. However, critics, including EU Commissioner Thierry Breton and AI researchers, argue against self-regulation, emphasizing potential safety shortcomings.

Crucial Decisions Loom: Self-Regulation versus Hard Rules

As the negotiations face increasing complexity, concerns grow over legal uncertainties affecting European industries. While some companies favor hard rules for products, the overarching challenge lies in finding common ground. Pending issues include the definition of AI, fundamental rights impact assessment, law enforcement exceptions, and national security exceptions. Spain, the current EU presidency, proposes compromises to expedite the process, but the looming possibility of a deal falling through raises apprehensions.
