Supreme Court Seeks Balanced Approach on Firecracker Restrictions, Says Religious Sentiments Will Be Respected
NEW DELHI, October 12, 2026 [VoM News]: The firecracker restrictions in Delhi-NCR matter has reached to the top court, where as per VoM sources, the top court has hinted to consider a balanced approach keeping the religious sentiments and concerns over deteriorating air quality concerns in consideration.
The matter is being heard by a bench headed by Chief Justice of India Surya Kant who observed that limiting firecracker use to specified hours could be considered as part of a practical solution.
“We will not hurt religious sentiments, but we will see what a balanced approach can be,” the Chief Justice said.
The court also emphasised public awareness and civic responsibility in addressing pollution during the festive season.
During the proceedings, a lawyer argued that bursting firecrackers was not an essential part of religious freedom. Justice Joymalya Bagchi questioned the connection between fireworks and religious practices.
The hearing forms part of a case dating back to 2015 concerning the manufacture, sale and use of firecrackers, particularly during periods of severe pollution in Delhi-NCR.
At an earlier hearing on September 30, another bench indicated that conditional permission for firecrackers could be considered.
Additional Solicitor General Aishwarya Bhati had sought time until October 15 to submit a Central Pollution Control Board report concerning barium-based firecrackers.
The court has yet to announce its final decision on the restrictions.
