Supreme Court Mandates Special Bench for Lawmaker Cases
The Supreme Court has taken a definitive step to expedite the legal processes involving criminal cases against lawmakers by instructing high courts to establish special benches dedicated to these cases. This initiative is part of a broader effort to ensure swift justice and uphold the integrity of the legislative bodies.
No Room for Delay
In an unequivocal directive, the apex court has strictly advised special courts to avoid unnecessary adjournments, allowing them only in exceptional circumstances. This move aims to address the backlog of over 5,000 pending criminal cases involving members of the Parliament and state legislatures.
Prioritization and Transparency
The Supreme Court has clearly outlined that cases involving lawmakers should be given precedence. Additionally, it has called for high courts to feature an independent section on their websites providing comprehensive district-wise details of these cases, including their filing year, number of pending cases, and current status.
Empowering High Courts for Effective Monitoring
With the power of superintendence vested in high courts by Article 227 of the Constitution, the Supreme Court has left the method of monitoring these cases to the discretion of the high courts. This is expected to lead to tailored strategies for efficient and effective case management.
