The Allahabad High Court has emphasized that a husband is duty-bound to provide maintenance to his wife, even if he has no income from a job.
The court dismissed a revision petition against a family court order, stating that the husband, if capable, should engage in physical work to meet the obligation.
The court rejected the husband’s claims of serious illness and lack of income, suggesting that he could earn about Rs 300-400 a day as an unskilled laborer.
The ruling underscores the obligation of spouses to provide financial support, even in the absence of formal employment.
