Delhi High Court Upholds Appointment of CBSE Chairperson, Dismisses Plea
The Delhi High Court has rejected a petition challenging the appointment of Nidhi Chhibber as the chairperson of the Central Board of Secondary Education (CBSE). The court stated that she possesses the qualifications required for the position and, thus, no writ of quo warranto is warranted.
Qualified Appointment Confirmed by Delhi High Court
In response to the petition by the Independent School Federation of India, the court found that Chhibber’s appointment was legitimate and met the necessary terms and conditions. This case of quo warranto was deemed unnecessary as the court upheld her qualifications for the role.
Misuse of Legal Action Alleged
The court expressed that the petition constituted a “gross misuse of law” and is typically employed when a person in a public office is found to lack the essential qualifications for their appointment.
Claims of Bureaucratic Reshuffle
The petition suggested that Chhibber was appointed due to a bureaucratic reshuffle and did not meet the required terms and conditions for the position. However, upon review of documents provided by Chhibber regarding her qualifications, the court found no merit in these claims.
