On Sunday, former Jammu and Kashmir chief minister Ghulam Nabi Azad expressed optimism about a favorable verdict from the Supreme Court regarding a series of petitions challenging the abrogation of Article 370 provisions in 2019. Azad, now associated with the Democratic Progressive Azad Party (DPAP) after leaving the Congress, conveyed that only Parliament and the Supreme Court hold the authority to restore Articles 370 and 35A to the people of Jammu and Kashmir.

Speaking to reporters, Azad emphasized the non-partisan nature of the Supreme Court bench and voiced expectations for a decision favorable to the people of Jammu and Kashmir. He noted the practical challenges of expecting Parliament to reverse the decisions of August 5, 2019, citing the necessity of a two-thirds majority in the Lok Sabha, which seems improbable given the current political landscape.

Azad dismissed the likelihood of Parliament reinstating Article 370 and Article 35A, asserting that it would require an unattainable 350 seats in the Lok Sabha. He highlighted that regional parties in Jammu and Kashmir, even with a limited number of seats, cannot influence such a change. Azad underscored that, despite having a majority, Prime Minister Narendra Modi refrained from taking such action.

According to Azad, the emotional attachment of the people of Jammu and Kashmir to the repealed constitutional provisions transcends political affiliations. Regardless of religion or ethnicity, the people harbor sentimental connections to Article 370 and Article 35A.

Azad stressed the significance of restoring these provisions for the well-being of the region’s present and future.Azad delved into the historical context, tracing the origins of these special provisions back to Maharaja Hari Singh in 1925. Enacted to safeguard land and job opportunities for the people of Jammu and Kashmir, these provisions became part of the country’s Constitution as Article 35A after independence.

Azad pointed out that despite various governments over the past century, there was no prior impetus to alter these provisions.
