Kejriwal Granted Bail in Delhi Liquor Case

Delhi Chief Minister Arvind Kejriwal was granted bail by the Additional Chief Metropolitan Magistrate (ACMM) of Rouse Avenue Court on Saturday, against arrest for skipping summons issued by the Enforcement Directorate (ED) in the Delhi liquor policy money laundering case.

Kejriwal Granted Bail:Court Appearance and Legal Representation

During the hearing, Kejriwal physically appeared before the court. ACMM Divya Malhotra granted bail to Kejriwal, noting that the Section 174 of the Indian Penal Code is bailable, and directed him to furnish Rs 15,000 in both complaint cases.

Kejriwal’s legal team, led by Senior Advocate Ramesh Gupta, along with Advocate Rajiv Mohan, Mohd Irshad, Mudit Jain, and Samprikta Ghosal, defended him against the ED, represented by Additional Solicitor General S V Raju, Zoheb Hossain, and Simon Benjamin.

On Thursday, it was revealed that Kejriwal had responded to each notice issued by the ED, yet the Directorate of Enforcement persisted in issuing notices under Sections 50 of the Prevention of Money Laundering Act (PMLA), disregarding his explanations for non-appearance.

Kejriwal Granted Bail:Challenges and Subsequent Proceedings

Kejriwal challenged the summons in the Sessions Court, asserting there was no intentional disobedience on his part. He sought a stay on proceedings before the Additional Chief Metropolitan Magistrate.

The court had recently taken cognizance of the ED’s second complaint, issuing fresh summons for Kejriwal’s appearance on March 16. The ED alleged non-compliance with summons in the Delhi liquor policy money laundering case.

The ED cited sections of various acts, including the CrPC and PMLA, in filing complaints against Kejriwal. Earlier, a summons was issued to him in the matter, to which he appeared virtually due to prior commitments related to legislative sessions.

    Kejriwal Granted Bail:Background and Allegations

The case stems from the alleged misuse of funds in the Delhi liquor policy, with the ED claiming kickbacks worth Rs 45 crore were used in AAP’s election campaign in Goa. The policy aimed to revitalize the liquor business in Delhi but was scrapped following allegations of irregularities.
