    Magistrate Rejects Bail for Impersonation:Investigation and Observations

    Special Municipal Magistrate Jammu Meyank Gupta has rejected the bail application of Firdous Ahmad Wagay, a resident of Waskora village of Central Kashmir’s Ganderbal who was arrested for impersonating as Under Secretary Raj Bhawan by a team of the Cyber Crime Investigation Centre for Excellence (CICE).

    After hearing both the sides, the court observed, “investigation of the case is still at infancy stage and yet the statements of material witnesses are yet to be recorded, call records/IPD records of applicant/accused are yet to be scrutinized and the evaluation of fake ID and stamps and other incriminating material in the possession of the applicant are required to be verified from the concerned departments”.

    “I am of the considered opinion that it’s too early to evaluate whether the accused is innocent as the investigation is still under progress and evaluating the investigation conducted so far, it is prima facie evident that the accused was having fake vehicle sticker of Raj Bhavan and fake rubber stamp of Financial Advisor and Chief Accounts Officer Department of Tourism Civil Secretariat J&K and identity card of Section Officer GAD Department”, the Magistrate said.

    “He has even submitted a fake ID Card of Head Assistant, Chief Secretary Office duly signed and stamped by SSP Security Civil Secretariat for staying in a hotel posing himself to be an employee of Civil Secretariat, cast a doubt on the conduct of the accused and the same can be evaluated by the IO after thorough investigation”, the court said.

    The rejection of the bail application underscores the gravity of the case and the need for thorough investigation before any judgment can be made. The accused’s possession of multiple fake documents and his attempts to impersonate government officials raise serious concerns about his intentions and potential criminal activities. As the investigation progresses, more evidence may come to light, shedding further light on the extent of the accused’s involvement in fraudulent activities.
