    Rajya Sabha Passes Monumental Bills to Overhaul Indian Criminal Justice System

    The Rajya Sabha successfully passed three significant Bills aiming to replace India’s antiquated legal framework consisting of the Indian Penal Code (IPC) of 1860, the Code of Criminal Procedure (CrPC), and the Indian Evidence Act. Home Minister Amit Shah, in his response during the debate, highlighted that these new criminal justice laws integrate India’s legal heritage and promise a substantial infusion of technology into the country’s judicial system.

    Known as the Bharatiya Nyaya (Second) Sanhita 2023, Bharatiya Nagarik Suraksha (Second) Sanhita 2023, and Bharatiya Sakshya (Second) Bill 2023, these Bills are set to replace the existing IPC, CrPC, and Evidence Act, respectively. Emphasizing the historical significance of these reforms, Shah emphasized that this marks the first-time comprehensive changes are being made to the laws that have governed the nation’s criminal justice system for nearly 150 years.

    Shah stressed that the implementation of these new laws will leverage technology to expedite justice delivery, intending to put an end to prolonged delays in legal proceedings. He noted that the primary objective of these Bills is not merely punitive but rather aimed at ensuring justice for all.

    Furthermore, Shah underscored the removal of the sedition section, replacing it with the offense of treason. He highlighted a shift in focus from prioritizing the protection of the treasury and the British Crown under the old laws to a more equitable emphasis on addressing crimes against women and vulnerable sections of society.

    However, during the debate, a notable absence of participation from most opposition parties was observed. This lack of involvement stems from the suspension of 46 opposition members from the House for the remainder of the winter session due to alleged “misconduct.”

    The amended Bills to replace the IPC, CrPC, and Evidence Act were initially introduced in the Lok Sabha by the Home Minister, marking a significant step towards redefining and modernizing India’s legal system.
