High Court Summons Ganderbal DC Over Contempt Case

SRINAGAR: The Jammu Kashmir and Ladakh High Court has summoned Shyambir, Deputy Commissioner of Ganderbal, to appear in person on August 5, 2024. This action follows a criminal contempt case brought against him under Section 15(2) of the Contempt of Courts Act 2015.
The case was initiated by Chief Judicial Magistrate Fayaz Ahmad Qureshi from Ganderbal district.
Shyambir is accused of disregarding a judicial order and allegedly engaging in attempts to personally attack the judge through “manipulation and fabrication.”
The case centers around a land acquisition dispute where petitioners claimed they had not received compensation from the government, despite a court decree in 2022.
In January, Qureshi instructed Shyambir to provide compensation to the petitioners. By June 21, Shyambir had reportedly not complied, prompting the judge to order the withholding of salaries for Shyambir and other officials.
The situation worsened when, on July 23, Qureshi accused Shyambir of retaliatory actions, including an investigation into the judge’s property as revenge for the court order.
The judge alleged that Shyambir, along with other officials, conspired to frame him in a fabricated case. It was claimed that Shyambir had even directed a patwari to probe land owned by the judge in Ganderbal.
The High Court, presided over by judges Sanjeev Kumar and Atul Sreedharan, issued a stern warning to Shyambir, stating that failure to respond to the summons could result in coercive measures. RA Jan has been appointed as amicus curiae to assist with the case.
The Chief Secretary, Atul Dulloo, has been informed and recommended to consider administrative actions against Shyambir, including a possible transfer.
