The High Court has resolved a writ petition brought forth by members of the Saini Community, instructing the Commissioner/Secretary to the Government, Social Welfare Department; Secretary, J&K Socially & Educationally Backward Classes Commission; and Divisional Commissioner, Jammu. The directive mandates that no Reserved Category Certificate be issued in favor of any Saini Community member. Furthermore, previously issued certificates will not be enforced until the government definitively determines the Saini Community’s status as a Socially Weak & Underprivileged Class (Social Caste).

These crucial directions, with widespread public implications, emanated from a writ petition submitted by Saini Community members, represented by Advocate Sheikh Shakeel Ahmed. During the proceedings, Advocate Sheikh Najeeb, representing the Saini Community, and Senior AAG Ramesh Arora, representing the Government, presented their arguments before Justice Rajnesh Oswal.Justice Rajnesh Oswal noted that the Social Welfare Department and Divisional Commissioner, Jammu, had responded, indicating that the S.O. No.537 dated 19/10/2022, which included the Saini Community in the category of Weak & Underprivileged Classes (Social Caste), had been suspended until further notice and was currently not in effect.

However, Advocate Sheikh Najeeb contested that the S.O. No. 537 dated 19/10/2022 was issued against the wishes of the Saini Community, which belongs to the upper caste and is not interested in availing reservation benefits. He further asserted that there had been widespread protests and discontent at various levels regarding the issuance of S.O. No. 537, with the Saini community vehemently opposing their inclusion among Weak & Underprivileged Classes (Social Caste).Taking into account the arguments presented by Advocate Sheikh Najeeb on behalf of the Saini community, Justice Rajnesh Oswal issued specific directives in response to the complex situation.
