Balancing Maintenance in Matrimonial Disputes

In a recent case of matrimonial dispute, a Dhanbad resident filed a petition seeking the revision of the maintenance amount granted to his wife. The court, while hearing the case, emphasized the importance of ensuring that maintenance amounts are fair and balanced.

Moral Duty vs. Financial Hardship

The court acknowledged that it is indeed the moral duty of a husband to provide maintenance for his wife, allowing her to maintain a living standard similar to that in her matrimonial home. However, it cautioned against making the marriage a financial burden for the husband, thereby turning it into a felony. Striking a balance is crucial in such cases.

Case Details and Revised Amount

The petitioner and his wife got married in 2018 but soon separated due to domestic disputes. During the proceedings, it came to light that the wife had filed income tax returns for several years despite claiming to have no income. The court acknowledged that even if the wife had income, she was entitled to maintenance from her husband. The petitioner also noted that he had to care for his ailing mother, a fact not adequately considered by the family court when determining the alimony amount.

The court partially allowed the revision petition and revised the alimony amount to ₹25,000 per month, emphasizing the need for fairness and balance to prevent financial hardship for the husband while ensuring a reasonable standard of living for the wife.

This case highlights the importance of assessing maintenance amounts realistically, considering the circumstances of both parties involved in matrimonial disputes.
